Terms of Service
1. Acceptance of Terms
By downloading, installing, or using the ChessViz application (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
2. Description of Service
ChessViz is a chess analysis and visualization application that allows you to:
- Analyze chess positions using an interactive graph visualization
- Import games from Lichess and Chess.com
- View personal game statistics and opening repertoire data
- Watch live chess tournament broadcasts
- Share analysis graphs via unique URLs
- Explore chess openings and master game databases
3. Accounts
3.1 Anonymous Usage
You may use the App without creating an account. An anonymous session is created automatically. Data from anonymous sessions may be lost if the App is uninstalled.
3.2 Registered Accounts
You may sign in with Google to create a registered account. This enables cloud sync, account recovery, and data persistence across devices. You are responsible for maintaining the security of your Google account.
3.3 Platform Linking
You may link your Lichess or Chess.com username to import your games. By doing so, you confirm that you are the owner of the linked account and authorize ChessViz to retrieve your publicly available game data via those platforms’ APIs.
4. User Data and Content
4.1 Your Data
You retain ownership of your personal chess data, including imported games, annotations, and analysis notes. We store this data on your behalf to provide the service.
4.2 Shared Content
When you share an analysis graph, it becomes publicly accessible via a unique URL. You are responsible for the content you share. You may delete shared graphs at any time, which will revoke public access.
4.3 Data Deletion
You may delete your account and all associated data at any time through the App’s settings. Deletion is permanent and irreversible. See our Privacy Policy for details.
5. Proprietary Assets
5.1 Our Intellectual Property
The following are proprietary to ChessViz and may not be copied, extracted, reverse-engineered, or redistributed:
- The App’s source code, user interface, and visual design
- The graph visualization engine and algorithms
- The pre-computed position evaluation database
- Prebuilt graph files and curated datasets
- The opening search index and ranking algorithms
- Cloud Functions, server-side services, and data architecture
5.2 Prohibited Uses
You agree NOT to:
- Reverse engineer, decompile, or disassemble the App or any of its components
- Extract, scrape, or bulk-download data from the App’s databases or APIs
- Redistribute the App’s bundled data assets (position database, graph files, opening data)
- Use automated tools (bots, scrapers) to access the App or its services
- Attempt to gain unauthorized access to our servers, databases, or other users’ data
- Use the App’s evaluation service to provide a competing chess analysis service
- Resell, sublicense, or commercially exploit the App or its data without written permission
5.3 Open Source Components
The App includes open source software components, including the Stockfish chess engine (GPLv3) on Android. These components are governed by their respective licenses. See the Open Source Notices screen within the App for details, including source code availability.
5.4 Third-Party Data
Chess game records (moves, results) are factual data and are not copyrightable. Opening names and ECO codes are standard chess taxonomy. The App uses the Lichess and Chess.com APIs in accordance with their respective terms of service.
6. Acceptable Use
You agree to use the App in a lawful manner and not to:
- Violate any applicable laws or regulations
- Harass, abuse, or harm other users
- Share content that is illegal, offensive, or infringes on others’ rights
- Interfere with or disrupt the App’s services or infrastructure
- Create multiple accounts to circumvent limits or restrictions
- Abuse the evaluation service (excessive requests, denial of service)
7. Service Availability
7.1 No Guarantee of Availability
The App is provided on an “as available” basis. We do not guarantee uninterrupted access. Features that depend on internet connectivity (game imports, cloud evaluation, broadcasts, cloud sync) require an active network connection.
7.2 Modifications
We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice. We may release updates that change functionality, and continued use after an update constitutes acceptance of changes.
7.3 Third-Party Dependencies
Certain features depend on third-party services (Lichess API, Chess.com API, Firebase). We are not responsible for outages or changes to those services.
8. Subscriptions and Payments
If the App offers premium features via subscription:
- Subscriptions are processed through Google Play (Android) or the App Store (iOS)
- Billing, renewals, and cancellations are managed by the respective platform
- We do not directly collect or store payment information
- Refunds are subject to the policies of Google Play or the App Store
9. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Chess evaluations, statistics, and analysis provided by the App are for informational and educational purposes only. We do not guarantee the accuracy of any evaluation, statistic, or analysis.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHESSVIZ AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR INTERRUPTION OF SERVICE, ARISING OUT OF YOUR USE OF THE APP.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify and hold harmless ChessViz and its developers from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third party’s rights.
12. Termination
We may suspend or terminate your access to the App at any time for violation of these Terms. You may stop using the App and delete your account at any time. Upon termination, your right to use the App ceases immediately.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles.
14. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If unresolved after 30 days, disputes shall be resolved through binding arbitration in the Commonwealth of Virginia, except that either party may seek injunctive relief in court for intellectual property violations.
15. Changes to These Terms
We may update these Terms from time to time. Significant changes will be communicated through a notice within the App. Continued use of the App after changes constitutes acceptance of the updated Terms.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
